In a recent podcast for the Federalist Society, I discussed with my fellow commissioner Bob Adler our differing views on the CPSIA, as well as how we reached those conclusions. I welcome these kinds of opportunities to openly discuss the consequences of the CPSIA and possible solutions for the future. Everyone agrees that the CPSIA needs some fixing. Let’s hope that Congress steps up to the plate. Anyway, have a listen, and give me some feedback on what you think.

I literally laughed out loud when Mr. Adler asserted that for the vast majority of businesses, CPSIA’s required testing will have no additional cost. He then went on to reveal his blind spot: he thinks that because he taught at a business college, he knows something about ALL businesses, when really what he knows is about LARGE businesses. I don’t know of a single Mom & Pop business that would even dream of implementing Six Sigma and other trendy business crap. And then he goes on to insist that if we weren’t testing before, our product must therefore not be worthy of sale.
